Charge Kambi With Abuse of Office, Cotu Tells DPP

Suspended Labour CS Kazungu Kambi should be charged with abuse of office despite being cleared by the DPP, Cotu has said.

Kambi was cleared over the lack of sufficient evidence and the existence of many “numerous” cases challenging two appointments to the NSSF board, DPP Keriako Tobiko said.

The suits and petitions before the Employment and Labour Relations Court and the High Court question the legality of Andrew Gichamba Muigai and Veska Kagongo’s appointments.

The pending cases are civil while the charges against the CS are criminal, Cotu said in a letter to the office of the DPP on Thursday.

Through lawyer Okweh Achiando, Cotu further said the evidence against Kambi was sufficient.

“The question your office needs to ask is how did he appoint the two board members and the manner in which he dismissed Aden, the former chair of the fund,” read the statement.

Tobiko turned down recommendations by the EACC to charge Kambi on Thursday last week.

The CS is also being probed for his involvement in the multi-billion-shilling proposed construction of 60,000 housing units by the NSSF and the construction of a business complex along Kenyatta Avenue.
